Biography

For nearly 40 years, Dan Utt has helped real estate owners, developers, investors, landlords, tenants and lenders navigate the issues and considerations associated with real estate development and general business law matters. Dan has significant experience with a broad range of real estate transactions, including the following:

  • Residential, retail, commercial, and mixed-use developments
  • Office, commercial and industrial building projects
  • Acquisition, development, and financing for senior living and multi-family communities
  • Evaluation and implementation of public and private incentives for real estate development
  • Evaluation, implementation, and leasing for construction contract, office, commercial, and shopping center development and lease transactions
  • Leasing transactions for office, industrial, and retail projects
  • Zoning and land-use planning matters
  • Organization of corporations, partnerships, and limited liability companies for a variety of transactions
  • IRC 1031 Transactions and Exchanges
  • Borrower representation for HUD, Freddie Mac, CMBS, and traditional financing for real estate projects

Dan is a licensed title insurance agent and is an authorized agent for Riverbend Commercial Title Services. Riverbend Commercial Title Services is an authorized agent for all of the major underwriters. Through Riverbend Commercial Title Services, the firm provides title insurance policies for purchasers and lenders and provides closing and escrow services.

Representative Work

Redevelopment of downtown surface parking facility into mixed-use project involving public parking, grocery store, and multifamily housing; public/private financing involving Greater Cincinnati Redevelopment Authority and City of Cincinnati

Represented FC Cincinnati in the property acquisitions, entitlements, development, and construction documentation for Soccer Stadium and Practice Facility involving Cities of Cincinnati and Milford, and the Hamilton County and Clermont County Port Authorities

Redevelopment of an airport site repurposed for hotel, retail, offices, and multifamily housing; public/private financing with Greater Cincinnati Port Authority

Represent Mobile Infrastructure Corporation, owner of 45 parking assets throughout the United States; representation includes structuring, acquisition, and financing of garage facilities in multiple locations

Represent clients in the entitlement, acquisition, and construction documentation for manufacturing facilities in multiple locations

Represent clients in the entitlement, acquisition, construction, and financing of multi-family properties in multiple locations

Newport Pavilion Shopping Center: entitlement, construction, financing, leasing, and disposition of large suburban retail shopping center
