Biography
Eric Cook serves as Of Counsel in the firm’s Business Representation & Transactions Group and is a key member of the firm’s Data Privacy & Cybersecurity Team. Eric is a business-minded attorney that provides strategic and practical guidance at the intersection of health, data privacy, and technology.
He assists businesses in all industries navigate various data privacy and security regulations and enforcement, with a particular focus on health and wellness, life sciences, healthcare, and advertising risks from federal and state privacy and security laws, including ethics and AI.
Eric’s practice includes supporting businesses in navigating the complex regulations surrounding leveraging data to assist businesses in providing products and services to improve health outcomes. He advises businesses on compliance with the Health Insurance and Portability and Accountability Act (HIPAA), including the HIPAA Privacy, Security, and Breach Notification Rule, the Health Breach Notification Rule (HBNR) and Section 5 of the FTC Act, state-specific health privacy laws (e.g. Washington’s My Health My Data Act (MHMDA)), comprehensive state privacy laws, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Children’s Online Privacy Protection Act (COPPA), the General Data Protection Regulation (GDPR) as well as guidance surrounding the use of tracking technologies such as pixels, chabots, and session-replay.
His experience includes providing guidance concerning data compliance risk and breach analysis for HIPAA, MHMDA, TCPA, CAN-SPAM, drafting HIPAA and AI policies and procedures, negotiating various technology agreements, including software licensing, SaaS, data processing agreements (DPAs), and business associate agreements (BAAs) as well as supple chain agreements.
