Biography
John Meisenhelder has extensive experience providing counsel to medium and large size companies (tax-exempt and for-profit) with respect to all employee benefits, executive compensation and privacy matters. John primarily focuses on the following areas:
- ERISA fiduciary committee governance structure and issues
- Qualified retirement plans, including cash-balance, ERISA and “church” plans
- 403(b) plans and compliance matters affecting tax-exempt hospitals, including those sponsoring “church” plans
- ERISA and state law (“church” plan) fiduciary matters related to litigation, plan governance and plan investments, including investments in employer stock and collective investment trusts (CITs)
- SEC disclosures for retirement plans holding employer stock
- Matters involving the Internal Revenue Service, Department of Labor, Pension Benefit Guaranty Corporation, Department of Health and Human Services and Hacienda (Puerto Rico)
- HIPAA privacy, security, breach notification and portability
- Executive compensation and nonqualified plans and related 409A and 457 matters
- International benefits, including in Puerto Rico and Canada
- Employee benefit aspects of business transactions
- Vendor and insurance contract negotiations and disputes
- GLBA and FACTA compliance, including the Red-Flag rules
- Withdrawal liability matters
John is also a Certified Public Accountant.
